In April 2024, following passage by the Maine Legislature, Maine Governor Janet T. Mills signed into law much-needed revisions to Maine’s 2021 first-in-the-nation “PFAS in products” law.
The changes, which the Maine State Chamber of Commerce championed, make Maine’s PFAS regulations more workable for businesses in our state, while continuing to protect public health and the environment. Since 2021, the Maine State Chamber, member companies, and other business groups worked diligently with the Mills Administration and state legislators to make sensible revisions to the 2021 law, which in its original form posed huge challenges for Maine companies by requiring them to test and report every product for sale or made in Maine for intentionally added PFAS. It also placed a 2030 ban on these products, and the testing and the reporting requirements were simply not possible, even for the most sophisticated businesses. The 2021 law - a response to major concerns about PFAS on Maine farms - encompassed nearly all Maine businesses and the unintended consequences for manufacturing, clean energy, and health products were potentially devastating. The law also made Maine an outlier. We are pleased that Maine’s revised PFAS law now exempts many business sectors from the ban entirely and extends the ban to 2040 for other industries, and that it largely aligns with Minnesota’s PFAS regulations, providing consistency across state lines. Maine’s amended PFAS law is more workable for businesses in our state, and importantly, protects Maine people, our state’s environment, and Maine’s economic future.
