ANTI-BUSINESS BILL L.D. 372

WE NEED YOUR HELP!

Businesses being Attacked for Good Will, Unintended Errors

CALL YOUR LEGISLATOR TODAY AND ASK THEM TO VOTE FOR THE HOUSE FLOOR AMENDMENT

L.D. 372 “An Act to Increase Enforcement and Accountability for Wage and Hour Violations”

This bill allows the Maine Department of Labor to impose HUGE liquidated damages and interest to Maine Businesses for Wage and Hour Violations for unintended errors. THE FLOOR AMENDMENT would improve the legislation by allowing businesses acting in GOOD WILL to NOT be assessed liquidated damages and interest. THIS AMENDMENT IS A SENSIBLE COMPROMISE that will allow workers to still get wages owed, while protecting them when clerical errors do inevitably happen.

  • Under current bill language, INDIVIDUAL LIABILITY EXISTS, including but not limited to:
    • Payroll companies
    • Shift supervisors
    • HR workers
    • Employees signing checks

This bill is a drastic shift in Maine DOL procedure. WHY should Maine businesses have to be presumed guilty from the start, when the burden of proof should be on the DOL to prove intentionality?? Your Legislators need to know that businesses acting in GOOD WILL towards their employees should NOT be penalized the same as legitimate bad actors.
